Here is the law, which is actually from the NJ Self-Defense bill that claims to give people the right to defend themselves and their property.

In other words, if you can avoid the use of force, or self-defense but giving in to the intruder then you are not permitted to use force against him. Lawyers will tell you that if you use force on an intruder instead of watching him remove all your possessions from your home, then you will be charged and wind up in court defending your actions.
