Actually, the FHA pulled its approval of the pricing plan. The governor of NY, who rushed it into place hoping to pre-empt any attempt by Trump to block it. It is unclear now what will happen. She says she will not remove the cameras of the pricing plan.

People need to understand that Manhattan is an island and the only access to Manhattan is though tunnels or over bridges. All of these are tolled. To get from NJ to NYC, it costs at least $16 during peak hours. Once into NYC there is another $9 charge for entering lower Manhattan during peak hours. Peak hours are any time of day when it might be reasonable to travel into NYC.

NJ residents pay $25 to get into lower Manhattan per day now. Point of fact, most cars and vehicles traveling to lower Manhattan are not NYC residents. Basically, they are charging a fee to come into their neighborhoods.

At first NJ politicians put up a fuss claiming to support and protect NJ residents who are footing this bill. But since this congestion pricing plan went into effect they have been silent. Another example of how Democrats do not care about the little people.

From a legal standpoint, this could go either way. Hochul has a strong argument that the city has a right to do their own planning, including for traffic. But, this is awfully hypocritical because state governments have been dictating all kinds of requirements on cities and towns for years with court approval. On the other hand, the right to unimpeded interstate travel has been upheld by the courts and is solid law at this point. The question is, can this doctrine be applied to cities, or areas of cities? And is the toll to enter lower Manhattan enough of a restriction to violate the constitution?

Personally, I think congestion pricing is a very bad idea. I think Trump is right. In the long run this is going to cost NYC revenue.
