Trump was charged with 31 one counts of violating this statute (relevant wording highlighted):
(e) Whoever having unauthorized possession of, access to, or control over any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it; or
31 one counts of retaining documents that should have been delivered to NARA upon leaving office.
Someone please explain to me why this same statute does not apply to Hillary, Biden, and Mike Pence - and probably every other president who kept documents after leaving office. The fact is, they are all guilty of violating this statute.
Where Trump has a serious legal issue is the charges of obstruction. He is accused of telling his aide to remove boxes of documents and hide them from the lawyers who were charged with going through all the boxes of documents and removing the top secret and classified items for delivery to the FBI. When his lawyers turn over the classified docs, and signed affidavits attesting that they were the only classified docs, they were unaware that Trump had hidden boxes of docs from them which also contained classified materials. Why Trump did this, I do not know. But the documents he hid were found when they raided his home at Mar-a-Lago. In fact, it was NARA who informed the FBI that there were still documents missing from what Trump turned over. That's when the FBI decided to raid Trump's home at Mar-a-Lago. During the raid, the hidden boxes were discovered and taken. Hence, the obstruction of justice charges against Trump and his aide. It is hard to defend these actions if true.
