California gets the reputation for being far left lunacy when it comes to government, but NY is far worse.
Let's look at some recent news from NY to understand just how far from a constitutional America NY really is.
E Jean Carroll claims Donald Trump raped her in an upscale department store sometime in the late 1990s. Of course she never reported this until around 2019. The problem is, the statute of limitations had already expired for her allegations so she could not press charges or sue. Not to worry. The NY legislature passed a law rescinding the statute of limitation for sexual assault crimes for a period of 12 months allowing Carroll to sue Trump in civil court. As a civil matter the burden of proof is simple a preponderance of the evidence or 51% to 49%. Of course this matters little in a district where 90% of voters voted against Trump. The important point is they changed the law to allow the suit against Trump then allowed the statute of limitations to revert back. This is against every intent of the bill of rights.
Then in Trump's real estate lawsuit brought by Letitia James, NY law does not require a victim in a case of fraud. That's right. Two parties can agree to a deal and if the DA does not agree, even years after the deal is done and both parties satisfied, under NY law the DA can sue either or both parties claiming fraud. On top of that, there is virtually no limit to the fines that can be imposed by the judge, despite no one claiming damages! Again, only in the state of NY.
Then, in this latest case involving Trump, NY allows a prosecutor to claim a predicate crime was intended or committed without specifying the predicate crime. In Trump's case, the DA claimed Trump falsified business records for the purpose of hiding another crime, but never specified the underlying crime. In fact, the judge allowed the jurors to find intent to commit any one of 3 predicate crimes even though the prosecution never presented any evidence that any of the 3 crimes was actually committed. The jurors found Trump guilty of 34 counts of falsifying business records, a crime which is a misdemeanor and the statute of limitations had expired, but the verdict doesn't even mention an underlying crime. This is allowed under NY state law. How can you prove intent to commit a crime without knowing what the crime is? The judge allowed the jury to find Trump guilty without unanimity on the underlying crime! All theoretically allowed under NY law.
My advice is, if you live in NY or you do business in NY, then get out. You are in danger of prosecution and may not have any idea why.
