This is people in the media trying to make a case for conviction in the Senate. But this is a laughable argument. First, no matter what their "experts" say, the law is the law. Free speech protects most speech. You can shout "Fire!" in a crowded theater if the theater is on fire. No court would convict a person for shouting "fire" if the person saw smoke.
When Trump says the election was stolen, it does not have to be true. If a reasonable person could conclude that the election was in some way fraudulent, then that person can yell, "fraud" all day without consequences. The evidence that fraud is possible is a mountain, not an ant-hill. Just because one person will not believe it, or the media denies it does not mean Trump cannot reasonably believe it.
Now I will state another argument. This article ignores the same chatter on Twitter. It only analyzed Parler traffic. But of course. I recall being on Twitter when Beto O'Rourke campaigned on gun control, and when Biden promised to make him his gun control czar. The talk of civil was went through the roof on Twitter, as it did after acts of violence perpetrated against MAGA hat wearing kids. The point is, we are all adults and we are responsible for our own behavior. A Bernie Sanders supporter took a rifle and shot 5 people on a baseball field almost killing Rep Steve Scalise. This was after Sanders had said Republicans didn't care of people died because they had no health insurance. The shooter even cited his remarks as he was taking aim at Republicans. If Trump is guilty of incitement, the so is Bernie, an a bunch of others.
BLM riots killed 47 people. We heard Pelosi, Harris, and other Democrats supporting the rioters and even telling them to keep the pressure on. Incitement? No one thought so then.
An impeachment trial is political and Senators can decide whatever they want. But this is a dangerous slippery slope. The question every American should be asking is, if Biden and the Democrats are so great, why are they afraid of Trump running again in 4 years?
